STAFF REPORT

During a preliminary hearing on Wednesday, TMZ reported that "Big Moe" - Anna Nicole Smith's former bodyguard - testified that he saw Howard K. Stern liquefying a powerful drug in Smith's bathroom.

The hearing, which opened Tuesday, is focusing on Smith's former lawyer-boyfriend Howard K. Stern and two doctors linked to 44 different prescription drugs she took toward the end of her life.

Stern, Dr. Sandeep Kapoor and Dr. Khristina Eroshevich stand accused of conspiring to illegally provide Smith with controlled substances. All three have pleaded not guilty.

Moe testified that he asked Stern what he was doing and Stern responded that he had just had a conversation with Anna Nicole and they had decided that cooking the Valium and injecting it into her would work faster than taking a pill, according to the report.

According to TMZ, Moe said he watched Stern load the syringe with liquid Valium but left before Stern allegedly injected her.

It allegedly happened at Smith's home in the Bahamas in October of 2006.

Moe, who tried to revive Anna Nicole the day she died, also told the judge she was high on Ecstasy before her bizarre appearance on the 2004 AMA awards, according to TMZ.

The Web site reported that Stern's lawyer said Tuesday that Anna Nicole had been suffering from seizures and that she was reacting to anti-seizure medication when she appeared drunk or high during the awards show.

Medical experts and pharmacists also are expected to testify along with the model's friends and associates.

At the end of the two-week hearing, a judge will rule, determining whether there is enough evidence to order the three to stand trial.
